There is a new sentencing framework for rape in Singapore. The Court of Appeal revised the framework for the punishment for rape, triggered by the appeal of Terence Ng’s appeal against his 13-year-jail term for the rape of his goddaughter.

Rape in Singapore will now be categorized into 4 bands:
1.       Rape in Singapore at the lowest end of the spectrum of seriousness, with no or limited aggravating factors. Sentence: 10 to 13 years with 6 strokes of the cane.
2.       Rape in Singapore at Band 2 have a higher level of seriousness and there are usually 2 or more offence-specific aggravating factors. Sentence: 13 to 17 years with 12 strokes of the cane.
3.       Rape in Singapore at Band 3 are extremely serious due to the number and intensity of aggravating factors. Sentence: 17 to 20 years with 18 strokes of the cane.

They key to the sentences relate to the manner and mode by which the rape was committed. For instance, group rape, abuse of position and breach of trust, violence and rape of a vulnerable victim, and hate crime are aggravating factors.

Personal circumstances such as remorse, other charges and antecedents will also be taken into account when deciding the punishment for rape.
